Pilot terms for institutions

These terms apply to every organization invited to the AgScore India pilot (FPOs, insurers, banks, government offices, and others), and to each person who uses an account for it. They are accepted when the organization's first user accepts the invitation, and form an annex to files 02, 03 and 04. If an agreement signed with the organization says something different, the signed agreement wins.

1. What the pilot is
A test of a service that makes satellite reports on farm fields ("Field Report (pilot)", with the AgScore score), for Paithan tehsil and nearby areas, from [start date] to [end date]. EO2DM may change, pause or end any part of it.
2. Provisional: not for credit or claim decisions
2.1 Every output (reports, scores, signals, evidence packs, district figures, exports) is provisional. Methods and thresholds are not yet calibrated or validated. Every page and file says "Pilot: provisional, not for credit or claim decisions".
2.2 You must not use an output as the basis, alone or mainly, for approving, refusing, pricing or recalling a loan; approving, reducing or rejecting an insurance claim; deciding relief or any payment to a farmer; or any other decision about a person.
2.3 Reports use satellite data only. A score is not a statement about a farmer's honesty or ability. "Not enough data" or "inconclusive" is not evidence against the farmer.
3. No warranty, limited liability
The service is given "as is". EO2DM gives no warranty that it is accurate, complete, available or fit for any purpose. [Lawyer: liability cap, for example the fees paid in the last 12 months, which is zero during the pilot; exclusions under Indian law.]
4. Price and caps
4.1 Members (farmers) never pay for their own reports.
4.2 Invited institutions pay nothing during the pilot, up to a monthly cap per organization (default [500] reports and assessments a month, changeable by EO2DM). Requests over the cap are refused until the next month.
4.3 After the pilot EO2DM plans to charge [₹150] per report. Nothing is charged without a separate written agreement or an order the institution places after being shown the price.
5. Acceptable use
You and your users must:
• use the service only for the pilot purpose in your agreement;
• keep your sign-in secret; one person per account; tell EO2DM when a user leaves;
• open a member's report only when the member has shared it with you;
• not try to find out who owns or farms a field, or link reports to people, using the service or outside data;
• not upload names, phone numbers, Aadhaar, bank, or land-record owner data (uploads with such columns are refused);
• not copy, scrape, resell or publish outputs, or use them to build a competing product;
• not test the service's security without EO2DM's written permission;
• keep outputs marked "provisional" when you share them inside your organization.
EO2DM may suspend an account that breaks these terms.
6. Farmers' data and consent
Access to a member's field is only through the member's share, which the member can stop at any time. Every access is logged and shown to the member. Members' names, phone numbers and notes are never shown to institutions. You must not ask a member to share as a condition of a loan, a claim, a scheme or any benefit [lawyer: confirm wording].
7. Confidentiality
Keep EO2DM's non-public information (methods, thresholds, unreleased results, the software) confidential during the pilot and for [2] years after. EO2DM keeps your non-public information confidential in the same way.
8. Intellectual property
8.1 EO2DM owns the platform, software, methods, models, scores and report formats (DECISIONS.md G4). Nothing in the pilot transfers them.
8.2 You keep ownership of the data you give EO2DM. You give EO2DM a licence to use it for the purposes in your agreement (including training and checking models where the agreement says so).
8.3 You may use outputs inside your organization for the pilot purpose. Satellite imagery is Copernicus Sentinel data (contains modified Copernicus Sentinel data [year]).
9. Data protection
EO2DM is the data fiduciary for the service and stores pilot data in India (AWS Mumbai). See files 01, 07 and 08. Each institution is responsible for the lawfulness of data it uploads.
10. Ending
Either side may end these terms at any time by notice. At the end, accounts are closed; reports already issued can still be checked on the public verification page. Clauses 2, 3, 7 and 8 continue after the end.
